Who we are

Elæris is made by Sarah Marie Farr, a sole trader, at 11 Medina Road, Hull, HU8 9QT, United Kingdom. You can reach us at hello@elaeris-app.com. These terms are between you and Sarah Marie Farr, trading as Elæris (we, us). By using Elæris you agree to them; if you do not agree, please do not use it.

What Elæris is, and is not

Elæris offers guided practices, sleep stories, journalling, reflections and small rituals for everyday wellbeing. It is not medical care, therapy, counselling or a diagnosis, and it does not replace advice from a doctor or another qualified professional. Nothing in it is medical advice. Gentle Patterns, early signs, My body today and the sentence written in Gentle Unburden are things noticed from what you have chosen to tell Elæris; they may be wrong, and they are never a diagnosis. Elæris is not an emergency or crisis service. If you are in immediate danger or thinking about harming yourself, call the emergency services or a crisis line straight away; Elæris lists them under If things feel too much.

Who can use it

Elæris is for people aged 16 and over, for their own personal use.

Membership and the free week

One membership opens everything in Elæris. Without a membership the app is closed, except for help when things feel too much, a 60-second breath, the short tour, the membership page, and exporting or deleting anything you kept.

When you choose a plan, the first 7 days are free with everything included, if you have not had a free week before. The plan then begins and renews automatically, monthly at £9.99 or yearly at £69.99, or the price shown for your country, until you cancel. Payment is taken by Apple from your Apple Account when the free week ends and at each renewal, unless you cancel at least 24 hours before. You can cancel at any time in your phone's Settings, under your Apple Account and Subscriptions, or from Membership in Elæris. When you cancel, membership stays open until the end of the period already paid for.

Prices include VAT. If a price changes, Apple will tell you before it applies to you, and you can cancel before it does. Purchases, refunds and billing are handled by Apple under its own terms. If you are a consumer in the United Kingdom you normally have the right to cancel a new subscription within 14 days and ask for a refund; to do this, or to ask for any other refund, go to reportaproblem.apple.com. Nothing in these terms takes away your rights under UK consumer law.

Your licence to use Elæris

We give you a personal, non-transferable licence to use Elæris on any Apple device that you own or control, as the App Store's Usage Rules allow. Please do not copy, sell, share, change or redistribute Elæris or its practices, recordings, pictures, music or words, and do not try to take it apart or get round the membership. Everything in Elæris is owned by us or used with permission.

What you keep in it

What you write, record and keep in Elæris is yours. We claim no rights over it, and we cannot see it. It stays on your phone. You are responsible for keeping your phone and Apple Account safe. Export a copy whenever you like.

Safety notes

Some practices involve candles, warm drinks, being outdoors, gentle movement or breathing exercises. Follow the safety note given with each one, stop anything that feels wrong, and use the alternative offered. If you are pregnant, have a health condition, or are unsure whether something is right for you, ask a doctor first. Practices are suggestions, never instructions. Do not listen to a sleep story or a meditation while driving or doing anything that needs your attention.

If something is wrong with Elæris

Elæris is digital content, and under UK consumer law it must be as described, fit for purpose and of satisfactory quality. If it is not, tell us at hello@elaeris-app.com and we will try to put it right; if we cannot, you may be entitled to some or all of your money back. If Elæris damages your device or other digital content because we did not use reasonable care and skill, we will repair the damage or pay you compensation. This does not affect your other legal rights; Citizens Advice can tell you more.

Changes and availability

We may add, change or remove practices and features, usually with an app update. We aim to keep Elæris working well but cannot promise it will always be free of faults or interruptions. If we change these terms in a way that matters, we will tell you in the app before the change applies, and if you do not want to accept it you can cancel your membership before then. If we ever stop offering Elæris, we will tell you in advance where we can, so you can export what you have kept.

Ending

You can stop using Elæris at any time, and delete everything you kept from Privacy and your data. We may end your use of Elæris if you break these terms in a serious way.

Responsibility

If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it is obvious it will happen, or if both of us knew it might happen when you began using Elæris. We are not responsible for loss that is not foreseeable. Elæris is for your own personal use, so we are not responsible for any loss of profit, business or business opportunity. Nothing in these terms limits responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow to be limited, and nothing affects your rights as a consumer.

Apple

These terms are between you and us only, not Apple. We, not Apple, are responsible for Elæris and what is in it. Apple has no duty to provide maintenance or support for Elæris. If Elæris fails to meet a warranty that applies, you may tell Apple, and Apple will refund what you paid for it, if anything; beyond that, and to the extent the law allows, Apple has no other warranty duty for Elæris. We, not Apple, are responsible for handling any claim about Elæris, including claims that it does not meet a legal requirement, claims under consumer protection or similar law, product claims, and claims that Elæris or your use of it infringes someone's intellectual property. You confirm that you are not in a country under a United States government embargo or named as a terrorist supporting country, and that you are not on a United States government list of prohibited or restricted parties. You must also follow the terms of any other service you use with Elæris, such as your phone network. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

Law

These terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you may also bring a claim in the courts where you live.
